Are food and hash illegal in Michigan?

One of the top questions that we get asked a lot lately is, “Is marijuana food and hash illegal in Michigan?”

 

The short answer is NO. Food and concentrates are protected under State law.

 

The confusion stems from a very goofy and poorly written opinion by the Michigan Court of Appeals.

The court concluded that food infused with marijuana and hash products, like wax, kief and BHO, or any product that was made with 100% extracted resins of the plant and contained zero plant material, was not protected under the Michigan Medical Marihuana Act.

In the same opinion the same court concluded that it was impossible to extract all plant material from resins and that if there was a method, no method exists to test if 100% of the plant material has been removed.

While we are not lawyers, and our opinion is simply that, an opinion. The gossip about food and hash not being protected under State law is false. This poorly drafted opinion was aimed at further harming patients and I for one am sick of the abuse of power and lack of our democratic process displayed by these not so honorable men and women.

The fact is that women and the elderly prefer food instead over smoking. These 2 demographics will be responsible for finally undoing the stigma of medical marijuana.

Our foes in the Michigan Court of appeals are fully aware of this and want to punish grandpa and women to get what they want.
