Legislative Opinion: “Clarifying” the Michigan Medical Marihuana Act

This article was originally published on the Marijuana Patients Organization site on September 17, 2014.

The MPO does not advocate Democratic or Republicans, only supporters of a compassionate and respectful leadership. We support politicians and government leaders that have an honest respect for the message voters approved in 2008 called the Michigan Medical Marihuana Act. Our State law provides for express, and absolute protection from State criminal prosecution. The Marijuana Patients Organization supports no change being the best strategy allowing this new industry to innovate. This can only happen when we arrest (interfere) less, honoring the voters clear and absolute intent as written clearly in the Act.

Michigan’s cannabis law provides near absolute ‘state’ criminal prosecution to patients and caregivers, and allows them to transact in commercial locations, back alleys. Basically anywhere. If any one reads the act, the clear language warns its residents about federal prosecution and not the disapproving Sheriff .

Caregivers are able to possess up to 15 ounces at any one time. Federal minimum sentencing guidelines begin at 16 ounces.

Gardeners can have up to 72 mature plants. Federal minimum guidelines start at 99 plants.

The law protects us from big brother, not sore losers.

With that said, a strong message to law enforcement and the courts need be delivered and a respect for our current law must begin now. Or, a simple, outright legalization.

Wishful thinking I fear.

A more medical approach to the Act could include two additional questions on state licensing forms. Administrative changes really. Or sent loudly by State leadership.
