Dear Sgt. Stewart:
As you are undoubtedly aware, I am an attorney in Southfield, Michigan. From time to time, I represent individuals formally accused of crimes in the criminal process or who are the subjects of a police investigation. I have a client(s) I am writing about such a situation.

It has come to my attention that members of the Oakland County Narcotics Enforcement Team executed a search warrant upon a building in Hazel Park on November 10, 2014. The circumstances leading up to the execution of the search warrant caught my attention. On information and belief, Det. Doty, acting in his capacity with NET, was investigating a “dispensary” in Pontiac, Michigan called the “Sky High Dispensary” located at 422 W. Huron, Pontiac, MI 48341. It is my understanding that during that raid, Det. Doty took a video of the raid on a mobile phone and then afterwards, met with a civilian, Gary Young, and shared the video recording with Young.

It is further my understanding that during their meeting, Det. Doty shared the following:

-advised Young about a list of state licensed caregivers that may have supplied SKY HIGH with medical cannabis;
-advised Young that his name was on the list but was removed by himself and YOUNG will no longer be a part of the investigation; and
-shared with Young information about a growing facility on Holly Road in Holly, MI located in a residential house in which Doty knew that Young was growing plants;
-shared with Young that the a police agency had knowledge that the home was being used as a growing facility; and,
-advised Young that it would be in his best interests to remove the plants at once.

t has come to my attention that Det. Doty and Mr. Young have been ‘best friends’ since 1990 and that Young was the best man at Doty’s 2011 wedding.

The events above led to the execution of a search warrant at 32 10 Mile Road in Hazel Park, Michigan on November 10, 2014. Apparently, a warrant was issued due to the claim of the smell of cannabis coming from the address. On information and belief, when officers executed the search warrant they confronted Young and seized several unprocessed plants. Det. Doty participated in the raid on the building and took part in the investigation.

I represent a client(s) with an interest in the property located in Hazel Park. After carefully considering the circumstances of the matter, I am left with more questions than answers. Assuming that the above is true, it reveals a startling departure from proper, legal and ethical police conduct. Clearly, the entire investigation is tainted. Property and evidence seized should be returned promptly and an internal inquiry begun into the conduct of the investigation. While I suspect that Det. Doty is aware of the above circumstances, I want to ensure that am the command structure is also aware and in the know. As I have indicated, the circumstances raise questions: does the command structure sanction, condone and/or permit this behavior and will these circumstances be ignored, glossed over and/or hidden?

Any information or property illegally taken during the execution of a search warrant at the building 32 10 MILE or any property or information from subsequent raids resulting from the investigation at the building should be considered invalid and returned immediately.
