Guns.  To some, they represent safety and security.  To others, they represent pure unbridled power.  While there will always be vigorous discussion on the proper role of these weapons in a society that holds dear both civil liberties and the right to bear arms, there is little debate that they have no place in a doctor/ patient relationship.  Sick people who, on the advice of their physicians, are seeking out medication should not have to fear police raids and SWAT teams as part of the process. Yet, police departments throughout the State of Michigan think this sort of harassment is a necessary ingredient to ensure the state’s medicinal marijuana initiative is properly implemented.

ACLU Asks Michigan Supreme Court to Hear Medical Marijuana Case

DETROIT – The American Civil Liberties Union of Michigan asked the state’s highest court yesterday to review the case of a registered medical marijuana patient who is facing felony drug charges despite complying with state law. If the appeal is accepted, it will be the first time the Michigan Supreme Court weighs in on the Michigan Medical Marihuana Act.

“The criminal prosecution of Larry King is a gross injustice,” said Dan Korobkin, ACLU of Michigan staff attorney. “Larry is a law-abiding citizen who followed all the rules. The overwhelming majority of Michigan voters approved the Medical Marijuana Act to protect people like Larry from criminal punishment.”

Emmet County Seeks AG Opinion

Emmet County may seek an opinion from the Attorney General regarding whether the Michigan Medical Marijuana Act (MMMA) allows dispensaries.  Based on recent actions and position of the Attorney General’s Office it seems that Attorney General Bill Schuette is not a fan of the Michigan Medical Marijuana Act.  But in an October 2008 Detroit News article Mr. Schuette mentioned that by not expressly prohibiting dispensaries or “pot shops”, they are allowed by implication.  It will be interesting to see if Emmet County submits its request and how the former judge, now AG responds.

Federal Agency Recognizes Marijuana’s Medical Benefit for People Living with Cancer

Washington, DC — A change to the National Cancer Institute’s (NCI) website earlier this month has caused a stir in medical marijuana and public policy circles, noting that the federal agency has uncharacteristically crossed a line in recognizing the medical efficacy of marijuana. NCI as part of the National Institutes of Health (NIH) has listed for the first time cannabis (medical marijuana) as a Complementary Alternative Medicine (CAM) in apparent contrast to information disseminated by the U.S. Department of Health and Human Services (HHS), which calls marijuana a dangerous drug with no medical value.
