Landlord not approving of grow

This article was originally published on the Marijuana Patients Organization site on October 11, 2011.

So I just realized that my landlord might not be very happy with my new garden if he encounters it. Can he tell me not to grow or evict me for growing? I was thinking maybe a grow tent could help the situation a little. I could really use some help on this one. Thanks.

  1. I’m not a lawyer but I’ve been told that a landlord can ask you not to grow simply because he/she owns the property and therefore makes the rules. Unfortunately the law does not specifically address whether or not a landlord may evict you for growing. The tent is a good idea but most models cannot be completely locked as a result of the many access flaps/ports that they contain. It sounds like you need something that locks in case anyone decides to take a peak inside. Just be cautious, this is still a gray area. If you’re really concerned, a brief legal consultation with an attorney that specializes in medical marijuana will give you more than enough info to make a decision and prepare a strategy.
