Today a few members of the MPO had the opportunity to sit proudly among several of our medical marijuana peers and listen to a room full of attorneys discuss and debate marijuana. Most notably, keynote speaker, former Attorney General Mike Cox whose words brought hope and encouragement to a very exhausted group of patient advocates. General Cox’s open and honest dialogue was refreshing and very entertaining, in fact all speakers presented extremely well.
The Attorney General attempts to rest his case on the fact that Federal Controlled Substances Law trumps the MMMA. While it is true that Federal law trumps or preempts state law, including the MMMA, that fact does not mean that police will be committing a federal crime by returning property that was wrongfully or illegally seized.
A lot of news has been surrounding the medical marijuana industry in Michigan as of late but possibly the most game-changing of these developments is the entry of a new company, VeriPatient, into the Michigan market. VeriPatient hopes to change the landscape by introducing the first patient verification system for dispensaries and caregivers based on a model approved by government officials, the medical community and law enforcement.

With the latest news that a group of individuals are trying to get a marijuana legalization question on the ballot in November, the familiar critics have come out to deride the current medical marijuana law as a trojan horse for legalization. While many may think this is exactly what all patients and caregivers want, it is actually the actions of our own state government, specifically Attorney General Bill Schuette that have forced the hand of proponents of safe access to marijuana for medical uses in the State of Michigan.
The Michigan Court of Appeals has determined that patient to patient transfers of medical marijuana creates a public nuisance and that only Caregivers may dispense the medicine to qualified patients. The courts looked to the Public Health Code for this determination, let us do the same and examine other aspects of the Public Health Code in order for your dispensary to remain compliant.
